1. Eligibility & age requirement

ThotDen hosts and links to adult, sexually explicit material and is intended exclusively for adults. By using this site you represent and warrant that you are at least 18 years old (or the age of majority where you live, if higher), that accessing adult content is legal in your jurisdiction, and that you're not viewing the Service from a location where doing so would violate local, state, national, or other applicable law. We may require age verification (for example, the age-gate confirmation on your first visit) before granting access, and we reserve the right to deny or revoke access to anyone we reasonably believe is underage or accessing the Service from a restricted jurisdiction.

2. Your account

Some features (buying a pass, reacting to a tile, leaving a comment) require an account. You're responsible for keeping your login credentials confidential and for all activity that occurs under your account, whether or not you authorized it. Notify us immediately at mattmadecley@gmail.com if you suspect unauthorized use of your account. Passes and account access are for your personal, non-commercial use only — don't share your login, sell or transfer your account, or use it on behalf of someone else. We may suspend or terminate an account that appears to violate this section without prior notice.

3. Passes, ad-supported access & payments

A pass unlocks every published collection on the site for its stated duration; it is not tied to any single collection. Alternatively, some collections can be temporarily unlocked at no cost by completing a third-party ad offer through our advertising partner — that unlock applies only to the specific collection you unlocked and lasts for the period shown at the time (currently four hours). Payments for passes are processed entirely by Stripe, our third-party payment processor; we never receive or store your full card number. By purchasing a pass you authorize Stripe to charge the payment method you provide for the listed price, plus any applicable taxes. See our refund policy for how refunds work. We may change pass pricing, durations, or the ad-unlock offer at any time; changes won't retroactively affect a pass you've already purchased.

4. Nature of the content

ThotDen primarily functions as a curated index and access layer for adult content that is hosted, in whole or in part, on third-party sites; some collections link out to galleries and videos we don't host ourselves. We do our best to only surface material we believe is used with appropriate rights, but we don't control third-party sites and can't guarantee their availability, accuracy, or continued existence. If a link breaks, a collection is taken down, or a third-party host changes its content, we're not liable for the resulting loss of access — see our refund policy if that happens while you hold an active pass.

5. Acceptable use

You agree not to:

scrape, crawl, mirror, redistribute, resell, or publicly rehost any content or data from the Service; circumvent, disable, or interfere with the paywall, ad-unlock flow, rate limits, or any other access or security feature; use automated means (bots, scripts) to create accounts, react, comment, or otherwise interact with the Service; post or transmit any comment or content that is unlawful, harassing, defamatory, infringing, or that depicts or promotes exploitation of minors in any way; attempt to gain unauthorized access to another user's account or to any non-public part of the Service; or use the Service in any way that violates applicable law in your jurisdiction. We may investigate and take appropriate action — including content removal, rate limiting, and account suspension or termination without refund — against anyone who violates this section.

6. Comments & reactions

Comments and reactions are user-generated content. You retain ownership of what you post, but you grant us a worldwide, royalty-free license to display, store, and distribute it as part of operating the Service. We don't pre-screen comments, but we may remove any comment, or suspend a commenter's ability to post, at our discretion — for example for spam, harassment, illegal content, or repeated rate-limit abuse. Comments and reactions are posted under a short, non-identifying label rather than your account email; don't include personal information (yours or anyone else's) in a comment that you don't want publicly visible.

7. Intellectual property

The ThotDen name, logo, site design, and underlying software are our property or licensed to us, and are protected by applicable intellectual property laws. Nothing in these Terms transfers any of that to you. Rights in the underlying adult content itself belong to the original producers and rights holders; see our copyright / DMCA policy if you believe something on the site infringes your rights.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LINKED THIRD-PARTY CONTENT WILL REMAIN AVAILABLE. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ThotDen AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DON'T ALLOW CERTAIN LIABILITY LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, liability, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third party's rights, including anything you post as a comment.

11. Termination

You can stop using the Service, or delete your account, at any time from your account settings. We may suspend or terminate your access at any time, with or without notice, for conduct that violates these Terms or that we believe is harmful to other users, us, or third parties. Sections of these Terms that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification, governing law) will survive.

12. Governing law & disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law principles, except to the extent your local consumer-protection law requires otherwise. Any dispute arising out of these Terms or the Service will be resolved through good-faith negotiation first; if that fails, in the state or federal courts located in Georgia, and you consent to personal jurisdiction there.

13. Changes to these Terms

We may update these Terms from time to time; the "Last updated" date above reflects the most recent revision. Material changes will be reflected here, and continuing to use ThotDen after a change takes effect means you accept the updated Terms.

14. Severability & entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with our Privacy Policy and refunds, copyright & support page, make up the entire agreement between you and ThotDen regarding the Service.
